Social Security Tribunal of Canada

People come to the Social Security Tribunal to challenge government decisions about their Canada Pension Plan, Old Age Security, Canada Disability and Employment Insurance benefits. Most people represent themselves, and many are vulnerable. The Social Security Tribunal provides a flexible, fair, accessible, and efficient appeal process, focused on the people it serves. Its members are expected to: conduct teleconference, videoconference and in-person hearings using active adjudication; write well-reasoned decisions using plain and inclusive language; meet productivity and timeliness standards; and support the tribunal’s access to justice initiatives.

General Division members mainly hear appeals about the Canada Pension Plan disability pension. They may also hear appeals about other Canada Pension Plan benefits, the Old Age Security pension, the Guaranteed Income Supplement, and the Canada Disability Benefit.

Position level GCQ-2
Full-time salary range: $121,100 - $142,400
Part-time per diem: $605 - $710

Appeal Division members hear appeals of decisions made by the General Division and by the Employment Insurance Board of Appeal and provide them with clear and consistent guidance. For employment insurance appeals, the Appeal Division intervenes if certain errors have been made. For income security appeals, the Appeal Division holds a fresh hearing.

Position level GCQ-3
Full-time salary range: $139,700 - $164,300
Part-time per diem: $700 - $820

Employment Insurance Board of Appeal

The Employment Insurance Board of Appeal was created under Part 5 of the Department of Employment and Social Development Act. Canadians who contribute to the Employment Insurance system are eligible for benefits under specified circumstances. People who are denied Employment Insurance benefits, following a decision on a request for reconsideration, have the right to appeal that decision. The Board of Appeal acts as an independent administrative tribunal composed of three member panels rendering decisions on all matters appealed under subsection 113 of the Employment Insurance Act. The Board of Appeal’s mandate is to provide simple, quick, fair and client-centric quasi-judicial services to Employment Insurance claimants and employers.

Members conduct hearings as part of three-member panels, mandated to provide fair and impartial quasi-judicial hearings and render decisions on first-level Employment Insurance appeals. Members work together to make well-reasoned written decisions on appeals concerning eligibility for benefits under the Employment Insurance program, including whether administrative penalties have been accurately assessed. Members are expected to ensure that appeals are dealt with quickly, fairly and efficiently, and in accordance with natural justice, applicable legislation, jurisprudence and departmental service standards.

Members appointed through this selection process have additional duties as presiding board members. Presiding board members preside over hearings and panel deliberations, manage procedural matters, oversee the decision-making process, and ensure the panel’s final written decision is completed in collaboration with the other members.

Position level GCQ-2
Part-time per diem: $605 - $710
Presiding board members receive an additional 4% in recognition of their additional responsibilities
